WASHINGTON — The Senate Banking Committee has advanced Brian Johnson’s nomination to lead the Consumer Financial Protection Bureau. The move sends President Donald Trump’s nominee to the full Senate for consideration.

The committee considered Johnson’s nomination during a September 17 executive session. Johnson previously held senior roles at the CFPB during Trump’s first administration. He later joined Capital One as a vice president. 

The Senate has not announced a date for a final confirmation vote.

Brian Johnson Moves Closer to Leading the CFPB

President Trump nominated Johnson to serve as CFPB director earlier this year.

The Senate Banking Committee held Johnson’s confirmation hearing on July 23. Senators questioned him about consumer protection, enforcement and the future direction of the agency. 

Committee Chairman Tim Scott supported Johnson’s nomination. Scott said he expects Johnson, if confirmed, to fight fraud and abuse, follow federal law and preserve access to affordable credit. 

Johnson Has Previous CFPB Experience

Johnson already knows the Bureau well.

During Trump’s first administration, he served in several senior CFPB roles. His experience inside the agency gives him direct knowledge of its regulatory and enforcement operations.

Johnson later moved to Capital One, where he served as a vice president. That role became a focus during his confirmation process. 

Democrats Question Johnson’s Capital One Ties

Democrats on the committee raised concerns about Johnson’s time at Capital One.

Sen. Elizabeth Warren, the committee’s ranking Democrat, asked Capital One for communications involving Johnson and the CFPB. Her request focused on the Bureau’s decision to drop a lawsuit against the bank. 

Capital One later told Warren that it was not aware of any outreach from Johnson to the CFPB about that lawsuit. Warren then asked the CFPB whether agency officials had contacted Johnson. 

Warren also criticized Johnson’s responses to questions about how he would run the Bureau. She opposed his nomination ahead of the committee vote. 

CFPB Leadership Could Shape Consumer Finance Policy

The CFPB oversees major parts of the consumer financial marketplace.

Its work touches mortgages, credit cards, personal loans, debt collection and other financial products.

A confirmed director can influence how the agency approaches supervision, enforcement and rulemaking. Johnson’s leadership could therefore affect banks, lenders, fintech companies and consumers.

Republicans have pushed for changes to the CFPB’s structure and regulatory approach. Democrats have argued that the Bureau needs strong enforcement authority to protect consumers.

What Happens Next

Johnson’s nomination can now move to the Senate floor.

Senate leadership has not announced when lawmakers will vote on his confirmation.

If the Senate confirms him, Johnson would take control of the CFPB during a major debate over the agency’s future direction, enforcement priorities and role in the financial system.
